In the board of AIG's defense, the original lawsuit was started by Starr International, a company led by AIG CEO Hank Greenberg, and some other shareholders. The board pretty much had to 'hear' the request that they join the suit, but then pretty much immediately agreed to not participate in it.

Not that it makes everything better, smelling of roses and tasting of chocolate, but at least a few of them have learned something.
